Magistrate Hadiru Daboh, who presides over at the Ross Road Magistrate Court No. 3 has discharged Sammah Fofanah, who was standing trial for the offence of causing money to be paid, an offence which is contrary to Section 32 (1) of the Larceny Act of 19916.
This happened when the defence counsel, Madie Sesay applied for a discharged of the matter. Mr. Sesay made his application pursuant to Section 94 of the Criminal Procedure Act No.32 of 1965. He added that the matter had been adjourned five times and the police prosecutor, Inspector A. Kamara, have not made any progress.
In response, Magistrate Daboh was left no alternative but rather he discharged the matter for want of prosecution.
The accused was before the court on one count of causing money to be paid, which is contrary to Section 32 (1) of the Larceny Act of 1916.
According to the police that Sammah Fofanah, on the 22nd January, 2021, at Kola Tree, Calaba Town, in Freetown, with intent to defraud unlawfully caused money to be paid to Six Hundred and Fifty Thousand (Le6050,0000) to Mariama Sallu Conteh to do course in Malaysia under Qnet, giving to her by her mother knowing the same to be false.
